810.03 Given on Elected Invention When Requirement Is Made Final
37 CFR 1.143 last sentence states: "[i]f the requirement is repeated and made final, the examiner will at the same time act on the claims to the invention elected." Thus, action is ordinarily given on the elected invention in the action making the requirement final.
