1302.05(a) Original Drawings Cannot Be Located [R-2]
When the original drawings cannot be located and the application is otherwise in condition for allowance, no "Official Search" need be undertaken. A replacement drawing should be obtained from the Office of Initial Patent Examination's records of the application as originally filed. If the reproduced drawings are not acceptable for publishing, applicant should be required to submit corrected drawings. An attachment to the Notice of Allowability should explain the problem and require the corrected drawings. >If such an attachment is not included with the Notice of Allowability, the Publishing Division will mail a "Notice to File Corrected Application Papers," giving the applicant a non-extendable period in which to file the corrected drawings.<
